The dispute between Apple and OpenAI is gaining momentum. After a high-profile lawsuit in which Apple accused the creators of ChatGPT of using confidential information about future AI devices, OpenAI published an official response. According to the company, many of Apple’s allegations are based on incorrect findings and false information.
OpenAI accuses Apple of serious errors in preparing its lawsuit
OpenAI claims that Apple misrepresented the course of earlier contacts between the two companies. According to a response filed by OpenAI, Apple's lawyers sent an email to the wrong person, confusing two similarly sounding Asian surnames. The company emphasises that Apple only admitted the mistake after it was pointed out. OpenAI also argues that Apple wrongly asserted it had tried to contact its chief legal counsel. The response notes that such a conversation never took place. Additionally, the company points out that former Apple employee Chang Liu was not accused by the iPhone maker during the initial contact, but was asked to help obtain additional information. According to OpenAI, this undermines the credibility of some of the arguments put forward by Apple. The company also says that any access by former employees to Apple's internal systems resulted from weaknesses in the maker's own security, not from OpenAI's actions. The response also emphasises that former head of Apple's design division, Tang Tan, repeatedly reminded the team not to use confidential materials originating from other companies. OpenAI accuses Apple of attempting to change the narrative by making general allegations against successive former employees. For this reason the company considers Apple's application for a preliminary injunction to be completely unfounded. The whole dispute will probably continue in court.
Apple and OpenAI are developing competing AI devices
Although the lawsuit concerns the alleged misuse of trade secrets, it underscores an escalating rivalry between the two companies in the market for AI-enabled hardware. According to earlier reports, OpenAI is working on several new devices, including smart headphones, a mobile AI device and its own smartphone based on AI agents. Plans reportedly also include a smart speaker fitted with moving mechanical parts and a battery. Apple is simultaneously developing its own AI projects. These reportedly include smart glasses, new generations of AirPods with AI capabilities, a smart home device with a screen and a robotic arm, and a pin or pendant that uses Siri. Both companies want to play a key role in the new generation of AI-based devices. However, it is hard to predict how the legal dispute will end and whether it will affect the pace of development of these products. What is certain is that the conflict between Apple and OpenAI has become one of the most high-profile technology disputes of recent months.
