The dispute between Apple and OpenAI is gaining momentum. After a high-profile lawsuit in which Apple accused the creators of ChatGPT of using confidential information about future AI devices, OpenAI published an official response. According to the company, many of Apple’s allegations are based on incorrect findings and false information.
OpenAI accuses Apple of serious errors in preparing its lawsuit
OpenAI says Apple misrepresented the course of earlier contacts between the two companies. According to OpenAI's response, Apple's lawyers sent an email to the wrong person, confusing two similarly sounding Asian surnames. The company emphasises that only after the mistake was pointed out did Apple admit the error. OpenAI also argues that Apple wrongly claimed it had tried to contact its chief legal counsel. In reply it noted that no such conversation ever took place. The company further points out that former Apple employee Chang Liu was not accused by the iPhone maker during the initial contact, but was asked to help obtain additional information. OpenAI says this undermines the credibility of parts of Apple's arguments. The company also maintains that any access by former employees to Apple's internal systems was due to shortcomings in the maker's own security, not actions by OpenAI. The response also highlights that former head of Apple's design Tang Tan repeatedly reminded the team not to use confidential material from other companies. OpenAI accuses Apple of trying to change the narrative by making broad allegations against multiple former employees. For that reason the company says Apple's application for a preliminary injunction is completely unfounded. The whole dispute is likely to continue in court.
Apple and OpenAI are developing rival AI devices
Although the lawsuit concerns the alleged misuse of trade secrets, it is set against a growing rivalry between the two companies in the market for hardware using artificial intelligence. According to earlier reports, OpenAI is working on several new devices, including smart headphones, a mobile AI device and its own smartphone based on AI agents. Plans also reportedly include a smart speaker fitted with moving mechanical parts and a battery. Apple is simultaneously developing its own AI projects. These reportedly include smart glasses, new generations of AirPods with AI features, a smart home device with a screen and a robotic arm, and a pin or pendant that uses Siri. Both companies want to play a key role in the next generation of AI-based devices. However, it is hard to predict how the legal dispute will end and whether it will affect the pace of development of these products. What is certain is that the conflict between Apple and OpenAI is becoming one of the most high-profile tech disputes of recent months.
