The dispute between Apple and OpenAI is gaining momentum. After a high-profile lawsuit in which Apple accused the creators of ChatGPT of using confidential information about future AI devices, OpenAI published an official response. According to the company, many of Apple’s allegations are based on incorrect findings and false information.
OpenAI accuses Apple of serious mistakes in preparing its lawsuit
OpenAI says Apple misrepresented the course of earlier contacts between the two companies. According to OpenAI's filing, Apple lawyers allegedly sent an email to the wrong person, confusing two similarly sounding Asian surnames. The company emphasizes that Apple only admitted the mistake after it was pointed out. OpenAI also argues that Apple wrongly claimed it had tried to contact its chief legal counsel. The response noted that such a conversation never took place. Additionally, the company points out that former Apple employee Chang Liu was not accused by the iPhone maker during that initial contact, but was asked to help obtain additional information. OpenAI says this undermines the credibility of some of Apple's arguments. The company also contends that any access by former employees to Apple's internal systems stemmed from weaknesses in Apple's own security, not from actions by OpenAI. The response also highlighted that former head of Apple's design department Tang Tan repeatedly reminded the team not to use confidential materials from other companies. OpenAI accuses Apple of trying to change the narrative by making broad allegations against multiple former employees. For that reason, the company says Apple's request for a preliminary injunction is completely unwarranted. The whole dispute is likely to continue in court.
Apple and OpenAI are developing competing AI devices
Although the case concerns the alleged use of trade secrets, the backdrop is an escalating rivalry between the two companies in the market for AI-enabled hardware. According to earlier reports, OpenAI is working on several new devices, including smart headphones, a mobile AI device and its own smartphone based on AI agents. Plans reportedly also include a smart speaker with moving mechanical components and a battery. Apple is simultaneously developing its own AI projects. These reportedly include smart glasses, next-generation AirPods with AI features, a smart home device with a screen and a robotic arm, and a pin or pendant that uses Siri. Both companies want to play a key role in the next generation of AI-powered devices. It is hard to predict how the legal dispute will end and whether it will affect the pace of development of these products. What is clear is that the conflict between Apple and OpenAI is becoming one of the most high-profile tech disputes of recent months.
